These Terms of Service govern your use of the Eggspert incubation and hatch tracking application. By using Eggspert, you agree to these Terms.
1. Eggspert Is a Tracking Tool
Eggspert provides tools for organizing incubation information, reminders, environmental readings, hatch records, statistics, and related information.
Eggspert does not guarantee hatch success, fertility, viability, animal health, incubator performance, or any particular incubation result.
2. Your Responsibility
You are responsible for the information you enter into the app and for decisions you make regarding incubation, equipment, eggs, animals, environmental conditions, and hatch management.
App reminders, calculations, dates, presets, and suggested milestones should be reviewed against the needs of your species, incubator, environment, and individual situation.
3. Notifications and Reminders
Eggspert may provide scheduled notifications and reminders, but delivery can be affected by device settings, operating system restrictions, battery optimization, permissions, software errors, device shutdowns, or other factors.
You should not rely on Eggspert as the only method for remembering time-sensitive incubation tasks.
4. Free and Premium Features
Eggspert may offer both free and Premium features. Free features, Premium features, limits, advertising, pricing, and availability may change as the app develops.
Premium may include benefits such as increased or unlimited hatch tracking, additional history, PDF reports, and an ad-free experience, depending on the version and platform.
5. Purchases and Subscriptions
Purchases and subscriptions are processed through the applicable platform store, such as Google Play or the Apple App Store. Billing, renewal, cancellation, refund, and subscription-management rules are generally governed by the applicable store and the purchase terms shown at checkout.
If Premium is offered as a recurring subscription, it may renew automatically unless canceled according to the store's subscription rules.
6. Advertising
The free version of Eggspert may contain advertising. Premium may remove advertising while the applicable Premium entitlement remains active.
7. Local Data and Backups
Eggspert may store hatch information and preferences locally on your device. You are responsible for keeping any records or exported reports that are important to you.
Eggspert is not responsible for data lost because of device failure, deletion, app removal, cleared storage, operating system issues, corruption, or other events outside the app's control.
8. Acceptable Use
You may not misuse Eggspert, attempt to interfere with its operation, bypass purchase or access controls, distribute malicious modifications, or use the app in a way that violates applicable law.
9. Intellectual Property
Eggspert, its branding, graphics, app design, software, website content, and related materials are protected by applicable intellectual-property laws. These Terms do not transfer ownership of Eggspert or its intellectual property to you.
10. Availability and Changes
Eggspert may be updated, changed, suspended, or discontinued in whole or in part. Features may be added, removed, limited, or changed over time.
11. Disclaimer of Warranties
Eggspert is provided on an "as is" and "as available" basis to the extent permitted by law. No guarantee is made that the app will always be uninterrupted, error-free, or suitable for every incubation setup.
12. Limitation of Liability
To the extent permitted by law, Eggspert and its developer will not be liable for indirect, incidental, special, consequential, or similar losses arising from use of or inability to use the app, including losses related to eggs, animals, hatch outcomes, equipment, data, or business activity.
13. Changes to These Terms
These Terms may be updated as Eggspert changes. The effective date at the top of this page will be updated when revised. Continued use of Eggspert after updated Terms become effective means you accept the revised Terms.
